KateTravel 预 定 条 款

请仔细阅读以下的预定条款,请在充分理解并同意以下条款后再做预定。本条款中所指的“我们”均为New Zealand Kate Travel Company Limited,缩写为KateTravel或KTL。

价格:所有价格均取决于是否有位,价格如撤回或更改恕不另行通知。价格只有在要求支付时得以保证。请注意,报价都有变动的可能,价格可能因我们无法控制的因素出现变化,这些因素包括汇率的波动、供应商单方面的调整、政府附加费和税收等。最新价格请咨询您的旅行顾问。

退款、更改和取消费:取消预定会产生费用,这些费用最多可能是支付的全款。我们的通用更改和取消政策为:一旦预定确认,并支付了定金或全款后,可免费更改一次,从第二次更改开始,每次每单收取10纽币更改费,所有更改取决于是否有位;如您在活动日2天前取消预定,您所支付的定金不予退回,或会被收取已支付全款的20%,如您在活动日2天内取消预定,您所支付的定金不予退回,并会从您预留担保的信用卡中收取剩余款项,或您已支付的全款不予退回;如您在活动日当天未参加活动,您也将会被收取全款。因供应商问题或天气原因的取消,全额退款;因签证拒签的取消,凭拒签信在活动日10天前免费取消。具体的更改取消和退款政策,以确认邮件或确认单上注明的为准。

定金和全款支付:我们有定金或全款支付的方式。定金为预定时支付的部分费用,需提供信用卡担保预定和余款。根据所预定的活动项目不同,定金为全款的10%至50%不等,余款在规定的期限支付,或在当地参加活动时支付给活动公司。全款为预定时支付的全部款项,您只需凭确认单参加活动,无需再支付费用。全款支付无需信用卡担保。

支付方式:我们提供新西兰公司账户的纽币转账或离线刷信用卡的支付方式,信用卡支付会涉及交易手续费,纽币汇率以新西兰境内外汇服务商提供的汇率为准。其他支付方式请咨询您的旅行顾问。

确认单和税务收据:确认单是您成功预定并支付后我们发给您的确认依据,通常是以电子文档的形式;确认单是供应商为您提供所描述的活动项目或服务的凭证,您必须事先打印出纸质确认单并在现场出示。作为新西兰的公司,我们没有义务提供中国意义的发票,我们根据客户需要,可以提供所支付款项的新西兰税务收据。

免责条款:我们仅仅是代理。我们代理销售各种活动项目、租车、住宿等产品和服务,我们的职责是按照客户的要求代表客户预定所有相关的活动项目,我们对所有销售的产品和服务不负任何责任,所有预定均取决于产品和服务供应商的条款和规则。您的法律关系主体是您和所预定项目的供应商,而非我们。因任何原因造成所预定项目或服务没有或没有全部履行,您应与该项目或服务的供应商交涉,而非我们。我们会尽到告知和协助的义务。我们对任何我们无法控制的因素不负任何责任,包括但不限于天气、汇率、税收、政治局势、天灾、不可抗力等等。

适用法律:本条款以英文版为准,中文版仅为参考。本条款适用法律为新西兰法律,如有争议,需通过新西兰法院裁决。


任何购买KateTravel的产品或服务意味着您完全理解并接受以上条款。


KateTravel Booking Terms and Conditions

Please read the following terms and conditions carefully.  You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean New Zealand Kate Travel Company Limited (KateTravel or KTL).

Prices: All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed when paid in full. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include but are not limited to adverse currency fluctuations, fuel surcharges, taxes increases, changes from tour providers. Please contact your consultant for up to date prices.

Refunds, Changes and Cancellation Fees: Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees and extra charges will apply where a booking is changed. Our general change and cancellation policy is that the changing fee is $10 each booking at each time, and the first-time change is no charge. All changes are subject to availability. All deposits is non-refundable once booking confirmed and paid. There is a 20% cancellation fee if the booking is cancelled more than two days prior to departure. There will be 100% charge if the booking is cancelled within two days before departure, or if a no show happens. The balance will be charged directly from the credit card in case of deposit bookings. There will be a full refund if the booking is cancelled due to service providers’ reason or weather condition. There will be no charge if you cancel your booking with your visa refusal letter ten days prior to departure. The specific policy of change and cancellation is subject to the confirmation email or voucher of the booking.

Deposit and Final Payment: You will be required to pay a deposit or deposits when booking. Your travel consultant will advise you of how much that will be. All deposits are non-refundable for changes of mind or cancellations. Final payment is required no later than 5 weeks prior to departure unless otherwise stated. Some services must be paid in full at the time of booking.

Payments by bank transfer and credit cards: Please note that bank transfer takes up to 2 business days to process. If you are paying by this method you will need to make the payment at least 2 business days prior to the actual due date. You must notify your consultant of your payment once it has been made. If you are paying by credit card, there will be a transaction fee incurred. The exchange rate refers to the organizations within New Zealand. Please contact your travel consultant for other means of payments.

Vouchers and invoices: A voucher is the proof of a successful booking. You need to print it out and show it to the provider on site. As New Zealand registered company, we issue tax invoices if you require an evidence of the payment.

Agency: We act as an agent only. We sell various travel related products on behalf of numerous transports, accommodation and other service providers, such as activities companies, car rental companies, coach, rail and cruise line operators. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not us. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.

Liability: We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control and which is not preventable by reasonable diligence on our part.

Special Requirements: Please liaise with your consultant regarding any special requirements you may have for your travel arrangements.

Passports & Visas: It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.  All travelers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport.

Travel Documents: Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking. It is your responsibility to collect all travel documents from us prior to travel. As a general rule your travel documents will be available for collection 2 weeks prior to departure, however this will depend on your individual arrangements. Please contact your consultant to confirm when your travel documents are ready for collection.

Monies Not Held On Trust: All monies paid by you to us will be the property of Kate Travel Limited and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided. You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.

Governing Law: If any dispute arises in relation to the agreement between you and us, the laws of New Zealand will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Zealand, and waive any right that you may have to object to an action being brought in those courts.

Acknowledgment: Any purchase of KateTravel’s products or service means that you understand and agree with the above terms and conditions.
